Welcome to Photo Wrapped. By downloading, installing, or using our application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Photo Wrapped, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Photo Wrapped is a mobile application that analyzes your photo library to create a personalized "year in review" experience, displaying statistics and insights about your photography habits during 2025.

3. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you should review these Terms with your parent or guardian.

4. User Permissions

To function properly, Photo Wrapped requires access to:

• Photo Library: Required to analyze your photos and generate your Wrapped experience
• Health Data: Optional, used to display step count statistics

You may grant or revoke these permissions at any time through your device settings. Revoking required permissions may limit or disable app functionality.

5. Purchases and Subscriptions

Premium Features: Photo Wrapped offers premium features available through in-app purchases. These may include:

• Weekly subscription
• Lifetime access (one-time purchase)

Payment: All payments are processed through Apple's App Store. By making a purchase, you agree to Apple's terms of service for in-app purchases.

Subscriptions: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings.

Refunds: Refund requests must be directed to Apple, as they handle all payment processing. We cannot process refunds directly.

6. Intellectual Property

Our Content: The App, including its design, graphics, text, and code, is owned by Photo Wrapped and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Your Content: You retain ownership of your photos. The App only accesses your photos locally for analysis purposes and does not claim any rights to your content.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App
• Violate any applicable laws or regulations

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTO WRAPPED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING OUT OF YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Photo Wrapped, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Apple-Specific Terms

If you are using the App on an Apple device, you acknowledge that:

• These Terms are between you and Photo Wrapped, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims related to the App
• Apple and its subsidiaries are third-party beneficiaries of these Terms
